Brand Authorization & NCNR Policy

By proceeding with this order, you (the Customer) acknowledge and agree to the following terms:

1. Brand Authorization

• You confirm that you are authorized to place this order on behalf of your brand(as stated on label).
• You authorize DinoLabelDigital (M/s Great Eastern IDTech Pvt Ltd., Plot No. 285, Udyog Vihar, Phase II, Gurgaon 122016, Haryana) to manufacture product labels using your brand name/logo as per the approved artwork.
• You declare that you are the sole owner of the brand and have no objections to the use of your brand name and logo for this purpose.
• You authorize DinoLabelDigital to supply labels to any third-party entity specified in the order.
• You acknowledge that DinoLabelDigital is not liable for any legal issues related to unauthorized use of a brand name/logo.

2. Non-Cancellable, Non-Reschedulable, Non-Returnable (NCNR) Agreement

• All purchase orders placed with DinoLabelDigital are Non-Cancellable, Non-Reschedulable, and Non-Returnable (NCNR) unless, mutually & explicitly agreed otherwise in writing.
• Once an order is placed, it cannot be cancelled, rescheduled, or returned for any reason.
• The delivery timeline confirmed by DinoLabelDigital is binding, and the Customer must accept the order as per the agreed schedule.
• This agreement overrides any prior or future agreements unless explicitly stated otherwise by DinoLabelDigital.

END USER AGREEMENT/ TERMS OF USE

These Terms of Use (or “Agreement”) sets forth legally binding terms and conditions and nature of the services that govern the use of the services offered at www.dinolabeldigital.com (hereinafter referred to as “DinoLabelDigital” or “Website”). DinoLabelDigital is owned and operated by Great Eastern IDTech Private Limited (“GEIPL”), a company incorporated under the Companies Act, having its office at 134, Arihant Nagar, Punjabi Bagh, New Delhi, Delhi 110026, India and is the sole owner, operator, author and publisher of the DinoLabelDigital (“Owner”).

 It is mandated that before using any of the services on the DinoLabelDigital, you must read and agree to these Terms of Use. 

By accessing or using DinoLabelDigital in any manner, including, but not limited to visiting or browsing on DinoLabelDigital or contributing contents or other material to DinoLabelDigital, you agree to be bound by these Terms of Use.

1. Introduction 

DinoLabelDigital is an online platform wherein the users can avail the services inter-alia of printing their own artwork as well as getting our assistance in designing their artwork which can be easily searched as well as accessed by the Customers/Consumers/Users (“User(s)”). Upon registration on DinoLabelDigital, the User can avail the services and do online purchases upon the terms and conditions set forth hereunder. Payment terms are advanced only.

2. Scope of Services

Users are granted permission to access and use the Website and its Content for the sole purpose of preparing, evaluating, and ordering products or services solely through DinoLabelDigital. Download, retention, use, publication, or distribution of any portion of Content is not authorized or permitted. Obtaining Products from DinoLabelDigital does not entitle you to use any portion of Content apart from the finished Products as supplied by DinoLabelDigital.

3. User Registration

• The Users agree to give his/her expressed consent to these terms prior to their registration for the purpose of availing Services on DinoLabelDigital;
• The Users shall provide current, complete and accurate information while registration on DinoLabelDigital; and
• By submitting the registration form, the User undertakes that the information provided by them for registration is true and correct.

• The User should be eligible to enter a legally binding contract and who is not barred by any law for the time being in force to enter into Terms of Use. In case of a minor (i.e., below the age of eighteen (18) years), it shall be presumed that the parent or guardian has accepted the Terms of Use on behalf of the minor and are present to monitor all activities on the websites being done by the minor. In the event of minor using the services on the Website, it shall be the responsibility of the parent or guardian to ensure that the information submitted on behalf of the minor is correct and true and the parent or guardian shall be held responsible and liable for any consequences in all regard.
• DinoLabelDigital reserves right to discontinue the Services, or deny access to anyone who violates the policies, conditions or Terms of Use stated herein.
• The Users shall be solely responsible for maintaining the confidentiality of their password given at the time of registration and for all the activities carried out under the account registered with The Users agree to prohibit others from using the password and undertakes to immediately notify DinoLabelDigital of any unauthorized use of the password or other security concerns.

6. Data Security

GEIPL  takes reasonable steps to protect the personal data we hold from misuse, interference or loss, and from unauthorized access, modification and disclosure. The steps we take to protect personal data include: 

• encrypting information sent between you and us using Secure Sockets Layer protocol (SSL) and 128-bit encryption (the highest level of encryption commercially available). DinoLabelDigital's SSL certification is supplied by Shopify (a US-based e-commerce building portal with in-built SSL Certificate Authorization); 

• outsourcing transaction processing to reputable, secure, Payment Card Industry (PCI) compliant payment gateway providers (such as RazorPay). DinoLabelDigital does not store or handle complete credit card data of buyers; 

• utilizing a fully secured technology stack on Amazon Web Services technologies. DinoLabelDigital’s databases are only accessible to certain IP addresses, locations, and servers. In addition, DinoLabelDigital has implemented parts of the SANS security guidelines for securing its database servers; 

• limiting access to users' personal data through secure login to the DinoLabelDigital website. 

Any breach of personal data will be promptly notified to our users and to authorities where relevant.

DinoLabelDigital reserves the right to refuse to accept any content provided by you to DinoLabelDigital or not to process any order at any time and for any reason. DinoLabelDigital also may terminate its service to and/or the accounts of customers found to be using DinoLabelDigital to engage in undesirable activities or otherwise violating Terms of Use.

Please note that DinoLabelDigital cannot be held responsible for: Spelling, punctuation, or grammatical errors made by the customer, inferior quality or low-resolution of uploaded images, design errors introduced by the customer in the document creation process, errors in user-selected options such as choice of finish, quantity or product type, and damage to the products arising after delivery to the customer. Please preview your designs carefully and correct any mistakes prior to placing your order. 

10. Taxes

All prices mentioned are exclusive of VAT/CST, service tax, Goods and Services Tax (GST), duties, and cesses as applicable – unless stated otherwise.

• Users shall be responsible for payment of all fees/costs/charges associated with the purchase of products from DinoLabelDigital and the Users also agree to bear any and all applicable taxes including but not limited to VAT/CST, service tax, GST, duties, and cesses, etc. 

• Customer agrees to mention GST registration number and Entity Name, wherever and if applicable. The Member will ensure that the GST registration number and the Entity Name, wherever and if applicable corresponds to the billing address provided, as no change in the said details will be allowed once the order is placed. 

• In the event, if the customer fails to furnish the GST registration number at the time of placing the order, the customer will be treated as ‘unregistered’ and will not be able to avail any input tax credit. 

• In any case, the liability of DinoLabelDigital under GST regime would be limited to the amount of tax charged by DinoLabelDigital, only.

11. Shipping and Delivery

• All Products purchased from the Website shall be delivered by the Logistics Partner engaged by DinoLabelDigital.

• DinoLabelDigital will endeavor to exercise its best efforts to provide expeditious delivery of the products on the estimated arrival date while placing the order. DinoLabelDigital shall not be held responsible and will bear no liability for any delays and/or damages caused. 

• The customer undertakes to provide an accurate postal address to facilitate delivery by DinoLabelDigital. Incomplete address details are likely to result in loss or delay of shipment. DinoLabelDigital will not be held liable for misplaced, lost shipments, delays, incorrect deliveries, or any other loss caused to the member.

12. Refunds

• Refunds are not provided on shipped orders (except where orders are canceled by DinoLabelDigital before fulfilment).
• Refunds, if any, shall be made at the same issuing bank through which the Product/Service was purchased. For payments made through electronic means like debit card, credit card, net banking, wallet, etc. refund shall be made via the same payment mode.
• On request from the customer, DinoLabelDigital is liable to provide ARN (Acquirer Reference Number) or UTR (Unique Transaction Reference Number) to the customer for refunds. However, in an event of non-receipt of such a refund in the designated Bank Account, it will be the responsibility of the customer to provide DinoLabelDigital with the set of documents required to support the claim of non-receipt. DinoLabelDigital through its payment’s service provider shall initiate the refund procedure post satisfactory verification of the documents provided by the customer.

14. Governing Law and Jurisdiction

These Terms of Use govern your access and use of the Website, which is being hosted by Shopify. These Terms of Use are governed by and construed in accordance with the laws of India, and the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. Any legal action or proceeding relating to or arising from your access to or use of this Site shall be instituted before the courts at Delhi, India. The courts in Delhi shall have exclusive jurisdiction in respect of any matters arising here. You agree, as DinoLabelDigital does, to submit to the jurisdiction of courts at Delhi, India. 

Some jurisdictions may provide the Users with certain warranties or guarantees that cannot be excluded by contract ("consumer guarantees"), or only limited in certain circumstances, and nothing in these terms of use alter those consumer guarantees if it is illegal for DinoLabelDigital to do so. If those consumer guarantees apply to the Users, and DinoLabelDigital cannot legally exclude those consumer guarantees, then to the maximum extent permitted by law, DinoLabelDigital: (1) excludes or limits those consumer guarantees; and (2) limits its liability at the option of DinoLabelDigital to the following: (a) in the case of services, the supply of the services again or the payment of the cost of having the services supplied again; (b) in the case of goods, the replacement of the goods or the supply of equivalent goods; the repair of the goods; the payment of the cost of replacing the goods or acquiring equivalent goods; or the payment of the cost of having the goods repaired. 

IN NO EVENT SHALL DINOLABELDIGITAL OR ITS LICENSORS, SUPPLIERS, OR DIRECTORS, EMPLOYEES, BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR FOR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA, OR PROFITS, WHETHER OR NOT DINOLABELDIGITAL HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGE, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SITE OR OF FAILURE TO PROVIDE PRODUCTS THAT YOU ORDER FROM DINOLABELDIGITAL, INCLUDING WITHOUT LIMITATION, DAMAGES ARISING FROM MISTAKE, OMISSION, VIRUS, DELAY, OR INTERRUPTION OF SERVICE. IN NO EVENT SHALL DINOLABELDIGITAL BE LIABLE OR RESPONSIBLE FOR ANY DAMAGES OR CONSEQUENCES ARISING FROM OR RELATED TO YOUR INAPPROPRIATE OR UNAUTHORISED USE OF THIS SITE OR ITS CONTENT OR OUR SUPPLIED PRODUCTS. IF YOU LIVE IN A COUNTRY OR STATE THAT DOES NOT ALLOW ANY OF THE FOREGOING EXCLUSIONS OR LIMITATIONS OF LIABILITY OR ANY OF THE DISCLAIMERS OF WARRANTIES IN THE ABOVE SECTION, SUCH EXCLUSIONS OR LIMITATIONS WILL NOT APPLY TO YOU BUT ONLY TO THE EXTENT SUCH EXCLUSIONS OR LIMITATIONS ARE NOT ALLOWED. IN SUCH CASE, SUCH EXCLUSIONS OR LIMITATIONS SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.

Any comments, suggestions, proposals or other feedback (collectively “Feedback Information”) provided to DinoLabelDigital in connection with the operation or content of this Site shall be provided by the submitter and received by DinoLabelDigital on a non-confidential basis. All such comments, suggestions, and other information shall become the exclusive property of DinoLabelDigital. By submitting any such information to DinoLabelDigital, you agree that you are transferring and assigning, at no charge, all of your right, title and interest in the information. You agree that DinoLabelDigital shall be free to use such information on an unrestricted basis.
